I got one more LUD for I-485
ie., I got One on Mar 18th and the othe LUD on Mar 25. What dows this mean.
Can somebody clarify...
It seems that whenever they open file a LUD is generated, e.g.
..FP done
..FP Oked
..I sent docs for e-filed EAD, when they received they put a LUD
Soft LUD is happening amounts to some activity happening with file/case.

I am in a difficult situation. I hope you can provide some guidance.
I am on 8th year of H1b. GC was messed up due to employer. A different employer has filed my labor 365 days before the I94 expires. I only have 3-4 months left on my current H1. I might have problems with my H1 transfer on time due to this new memo as I am working in layers, and I might loose my H1 status.
My wife is on F1 visa and I would like to know if
1) I can get H1 to F2 transfer. I have all recent paychecks etc and still working?
2) If I get F2, can I find a new employer who can sponsor my H1 (full time not a consultant) while in US and then do F2 to H1. I am assuming this will be a new term of H1 within the limits of the quota etc.
OR
I have to go back to my country for 1 year if I want to be on H1 again? Here I am assuming that I can re-enter the country on F2 visa then find a new sponsor. Do you see any problems with the above?

Dallas-Fort Worth Immigration Lawyer Has Just Posted the Following:
Effective January 4, 2010, the U.S. Department of Health and Human Services, Center for Disease Control and Prevention (HHS/CDC) is removing HIV from the list of communicable diseases of public health significance and references to HIV from the scope of medical examinations for foreign nationals.
Until the rule goes into effect, non-citizens who are HIV-positive cannot be admitted into the U.S. unless the U.S. Department of Homeland Security (DHS) grants a waiver. Once the rule goes into effect on January 4, 2010, HIV infection will no longer be defined as a communicable disease of public health significance, immigrant visa applicants who are required to undergo a medical screening exam will no longer be tested for HIV, a waiver for entry into the U.S. will no longer be necessary, and HIV-positive visa applicants will not be found ineligible for visas under Section 212(a)(1)(A)(i) of the Immigration and Nationality Act (INA). Although foreign nationals with HIV who apply for visas will no longer be ineligible under INA Section 212(a)(1)(A)(i), they still must overcome the public charge under INA Section 212(a)(4) by demonstrating to the consular officers that they will have the means of support in the U.S. and that they will not need to seek public financial assistance. Why do you think anyone in India including the government will spend there political good will to help people like us? Since we are planning to leave India for good and possibly become USC in due course of time there is nothing to gain from helping people like us. . They might ask for H1/L1 etc because it impacts Indian companies.

If you wish to travel to England to travel to another destination without going through the Danish border and you have no right to carry in the UK without a visa, you need a direct airside transit visa, unless exemptions they direct airside transit visa. If you are a visa national and you pass through immigration control because you stop in the United Kingdom for over 24 hours you should use a visitor in transit visa.

You will not jeopardize your I-485 as long as job with company C is in same or similar occupation. Whether USCIS will grant an H-1 3 year extension based on a withdrawn/revoked I-140 is not certain. I outlined the reasons for this uncertainty in my response on the thread entitled "Facing Layoff---6 months left..."

Are there instances where the processing time before interview will exceed to more than 3 mos? Is it also true that during the embassy interview, you are currently working? I am a nurse and my agency told me that I should still be practicing as a nurse during the time my packet 4 comes.

If you labor is approved by July 31st, you can file your I-485 by August 17th.
If your labor is approved on Aug 1st or later, you'll not be able to file I-485 at this time. You can, of course, file I-140.
You can apply no matter when your PD is if you have the labor approval hard copy.....

I am planning to use AC21 by joining a company on this March month end , I asked new company to process H1, and its in progress.
In APRIL Visa Billiton my PD is current, as I have PD of JUNE 2001( EB2), my RD - JUNE 29, 2007 .at this stage if I change company what is the impact on my GC approval. Should I wait for some more time to join the new company?

There's no set time for getting a greencard. It depends on which EB category you're in and the visa bulletin's priority dates.

I work in a semiconductor company and got laid off last week. My company informed me that they will inform INS to cancel my H1B in May. I plan to go back to school and change my status to F1. My question is, to do a change of status from H1 to F1, will they ask my recent pay stubs? Please reply
