A thought about meeting the Senators/Congressmen.
Should we not meet the new senators and congressmen now, BEFORE they actually join office? I have a feeling that once they take office, they will become too busy with day to day stuff and immigration will DEFINITELY become a back-burner issue.
Is it possible to meet the new people moving in after January, now instead of after they take office?
Pls join your PA state chapter first in order to execute the action items. Meeting the lawmakers is one of the action items in the list. we cannot undertake such efforts without enough members in state chapters. pls also urge others you know from your state to join the chapter and get active.

I am from PA. I am a June filer. My wife who is a primary applicant, got EAD for her and our son in the first week of Aug(after finger printing). I did not get my EAD so far. I had been to Philadelphia after getting INFOPASS appointment last week. Nothing happened there, just waste of time! It seems that there are no rules/ regulations in this system. Many of my friends got their EAD before FP. One of my friends got his GC without I-140 approval. The whole GC system is in big mess.

as far as I know medical assistant position does not require a degree and hence does not get entitled to highly skilled H1 category. Once this is not a skilled profession, one will have to prove that there are no citizens/gc candidates available for this position.
There could be a category of H1 visa for this. talking to lawyer is ur best bet.
FYI:
My wife is B.A.M.S, after researching all options, started studying nursing (accelerated bechelor of nursing ). During her research she did not find any other choice worthwhile!

Hi Gurus,
My PD is 04/2002 and RD is 18/June/2007, EB3 India. EAD approved and fp done in Aug.
There are no soft LUDs on my 485 after 7/17/2007. What does this mean? Is there a way to check if I am stuck in name check?
I see many people with later RD and PD getting soft LUDs. Is anyone else in the same boat? Please advice..

Hello everyone,
I am in a very bad condition n would appreciate anyone who can advice me on same. I had been out of status for about 1 yr n 2 months following my denial of I 140 n expiration of H1b, n currently residing in US. Now i have a new approval for H1b from USCIS, a month back. I was instructed by my employer to go back to my native country n get approval from from the consulate n re enter US. My lawyer instructed that i will be barred at the consulate or at the airport due to the history of over stay in US upon re-entering . Is there any one who have heard experinces of this kind ever? plz share your knowledge... thanks

What was your I-485 receipt date (Note: I am not asking for your PD)

I don't know if here is right place to post this or not. I responded to RFE about 30 days ago and got an email update that TSC has got my response and the case processing is resumed. That was 485 and TB skin test that I had to do again.
Anyone has any idea what is normal time after response to RFE? I am EB3 with PD of Oct, 2003.
Do you recemmend me to call service center or go for infopass?

AILA provided a very important update from the State Department, we wish to share with our readers.
The Department of State has issued comprehensive new policy guidance on the use of DNA testing in the visa application process. This new guidance is set forth in a new set of extensive Notes to 9 FAM 42.44.
In this new guidance, the State Department declares DNA technology to be the only acceptable non-documentary method for proving a biological relationship. The preferred specimen collection technique for DNA testing is by buccal (cheek or mouth cavity) swab.
According to the Department, DNA testing is expensive, complex and time consuming and thus should be recommended only if no other credible proof of the claimed relationship exists. Consular officers should treat DNA testing as a last resort: all other possible methods for confirming the existence of a biological relationship must be exhausted before recommending this course of action. Even then, DNA testing may only be recommended, but never required by the consular officer.
Consular officers may recommend DNA testing solely to prove a relationship; they may never recommend DNA testing in an attempt to disprove a relationship. Only DNA test results reporting a 99.5 percent or greater degree of certainty as proof of a biological relationship between a parent and child may be accepted in visa cases.
The Department clarifies that consular officers adjudicating Form I-130 Alien Relative petitions (http://www.h1b.biz/lawyer-attorney-1132137.html)are not authorized to approve the petition if DNA test results are the sole evidence of the claimed biological relationship. Such cases are not "clearly approvable" per the provisions of 9 FAM 42.41 N4.2-3; accordingly, they must be forwarded to USCIS for adjudication. Parenthetically, USCIS is authorized to approve I-130 petitions supported solely on DNA testing.

Hi all,
Please let me know what could be the problem. On Apr25, my status changed to Case Received and Pending. Last Updated Date is 05/18.
When i contacted my employer, he says my petition is approved. But still when i find the status online, it's not reflected.
What could be the problem?
Any thoughts would be highly aprpeciated.

My wife is currently on h4. She has applied for H4 to F1 trasfer i539 application with university A in May 2008. She is currently enrolled in University A on H4 as her application is pending. Now she got admission from a better unversity (starting Spring - Jan 2009) and she wants to join this university. What is the process to transfer her university given her i539 application is still pending (and probably remain pending till early 2009).

Can a H4 visa holder apply for the Praxis test series and then apply for State Teacher Certification. I know on H4 we can't work but is it possible , just getting the Teacher Certification.
I believe that you can take tests as long as you formally study on your own. But get this confirmed by a lawyer.
If it's not possible on H4 then I have an option to convert H4 to L2 (as my husband will change his status from H1 to L1) and get EAD.
Just a clarification: If your spouse changes from H1 to anything, your H-4 status is automatically terminated; there is no "option" to retain it.
Can after that can I get the Teacher Certification from PA ?
I checked on PA State Teacher Certification requirement for Foreign Educated Teachers and there is one point like this.
- is a citizen of the United States or holds an resident alien (green card) visa

My confusion is, as soon as I enter on AP I am on EAD and I don't have approved EAD. Does this mean I can not work untill I get EAD approved? I don't have Visa Stamped and I am not planning for Visa Stamping.
you can still continue on H1B (same employer) as long it is validity..even when you use AP at POE..
